Terms
Terms of use
The short version: log what you listen to, be decent to people, only post what’s yours to post, and don’t try to break the site. Your words stay yours. Spin Diary is free and provided as it is.
1. Using Spin Diary
Spin Diary is run by Obegi Software LLC, a Washington limited liability company (“we”, “us”). By making an account or using the site you agree to these terms and to the privacy policy. You need to be at least 13, and old enough where you live to agree to terms like these on your own (or have a parent’s permission).
Spin Diary is free. There are no paid plans and nothing on the site takes payment.
2. Your account
- One person per account. Pick a handle that isn’t pretending to be someone else.
- Keep your password and recovery code safe. You’re responsible for what happens on your account; tell us if you think someone else got in.
- To protect accounts, we may refuse passwords that are very common or known from data breaches, and we slow down or pause sign-in after repeated wrong passwords.
- Email is optional. If you add one, keep it current if you want notifications and password resets to reach you.
- You can delete your account any time in Settings.
3. What you post, and what’s ours
Your reviews, etchings, lists, replies, messages, profile and uploads are yours. So we can run the site, you give us a non-exclusive, worldwide, royalty-free licence to store, show, reproduce and format them on Spin Diary, in share images and link previews, and to people you send them to, for as long as they’re on the site. Deleting something (or your account) ends that licence, except for copies people already shared elsewhere.
Only post things you have the right to post. Short quotes of lyrics or reviews are fine; whole articles, full lyrics or other people’s photos are not.
The Spin Diary name, logo, design and code belong to Obegi Software LLC. Sharing links and share cards is fine; copying the site itself is not.
4. Be decent
Don’t use Spin Diary to:
- harass, threaten, bully or dox anyone, or post hate against people for who they are;
- post sexual content involving minors, sexual content without consent, or graphic violence;
- spam, advertise, run scams, or pretend to be someone you’re not;
- post things that break the law or someone else’s rights;
- scrape the site in bulk, get around blocks or rate limits, probe for security holes without telling us, or overload it.
There’s no tolerance for objectionable content or abusive users. Content like the above is removed, and people who post it can lose their account.
Disagreeing about music is the point: a 2/10 for someone’s favourite album is allowed. Being cruel to the person isn’t.
5. Moderation
You can block anyone and report reviews, replies, guestbook scratches, messages and profiles. Each report goes to our moderators, who can remove the reply, scratch or message, or clear a review’s words (the score stays). We may suspend or delete accounts that break these terms. We aim to deal with reports promptly. If you think we got it wrong, tell us.
6. Listening clubs
Anyone can start a club, and clubs are invite only. The person who starts a club names it, invites people, and can remove members or delete the club. Members take turns picking each week’s record and can leave any time. Club names, picks and notes follow the same rules as everything else here.
7. Other services
Album details, covers and previews come from services such as Apple Music, MusicBrainz, Deezer and Wikipedia, and belong to their owners. Connecting Last.fm, Spotify or Apple Music, or importing from Musicboard, Rate Your Music, Discogs or Last.fm, is up to you and also subject to those services’ own terms. We’re not affiliated with any of them.
8. Email and notifications
If you add an email address, we only send what you’ve switched on (notifications), what you asked for (confirmation and password reset links), and security notices (your password or email changed). Every notification email has an unsubscribe link. In the iOS app, notifications are sent only if you allow them, and you can turn them off in your iPhone’s Settings.
9. The iOS app
These terms cover the Spin Diary app for iPhone too. The app is licensed to you, not sold, for your personal use on Apple devices you own or control, as the App Store’s usage rules allow. These terms are between you and Obegi Software LLC, not Apple. Apple isn’t responsible for the app or its content, has no obligation to provide maintenance or support for it, and isn’t responsible for any claims about it (including product liability, legal or regulatory compliance, consumer protection, or intellectual property claims); those come to us. If the app fails to meet a warranty that applies by law, you can tell Apple, and Apple will refund what you paid for it (the app is free); Apple has no other warranty obligation. You confirm you’re not in a country under a U.S. government embargo and not on a U.S. government list of prohibited or restricted parties. Apple and its subsidiaries are third-party beneficiaries of these terms and can enforce them against you as they relate to the app.
10. The fine print
- As is. Spin Diary is free and offered as it is, without warranties of any kind. Features can change or stop, and it can be down sometimes. Keep your own copy of anything important (Settings has a download).
- Limits. To the fullest extent the law allows, Obegi Software LLC isn’t liable for indirect or consequential losses, or for lost data, arising from using the site. Nothing here limits rights the law says can’t be limited.
- Ending. You can stop using Spin Diary and delete your account whenever you like. We can suspend or close accounts that break these terms, or close the site with reasonable notice.
- Changes. If these terms change in a way that matters, we’ll update the date and say so on the site before it applies. Carrying on using the site after that means you accept the new terms.
11. Governing law
These terms are governed by the laws of the State of Washington, United States. Nothing here takes away rights the consumer law where you live gives you.
12. Contact
